Terms and End User Agreement
These terms apply to the Road Alert app, website and related services.
Acceptance
By using Road Alert, you agree to these terms. If you do not agree, do not use the app or related services.
Driver responsibility
Road Alert is a road awareness tool. It does not replace road signs, traffic laws, posted speed limits, route planning, official directions, Police instructions, emergency services, transport agencies, commercial driving obligations, permit requirements or driver judgement.
Where New Zealand road law applies, users remain responsible for complying with the Land Transport Act 1998, the Land Transport (Road User) Rule 2004, any applicable transport rules, permit conditions and all lawful directions from enforcement or emergency authorities.
No guarantee of accuracy or availability
Alerts, reports, locations, status information, traffic cameras, official feeds and community reports may be delayed, inaccurate, incomplete, duplicated, unavailable, expired or removed. You remain responsible for driving legally and safely at all times.
Safe use
Do not interact with Road Alert while driving. Reports should be submitted by a passenger, or by the driver only when safely stopped and legally parked. Do not use Road Alert in any way that distracts from safe driving.
Permissions and notifications
Some features require location, background location, notification, audio and network access. If permissions are denied, restricted by battery settings or disabled by the device, some alerts may not work.
Community reports
Reports must be submitted in good faith. Do not submit false, abusive, discriminatory, threatening, private, illegal, unsafe or misleading content. Do not include personal information about other people.
Moderation and report handling
Road Alert may moderate, correct, move, confirm, reject, archive, remove or prioritise reports and feedback. Road Alert may restrict access, remove content or take other action if the service is misused.
Official and public data
Road Alert may display data from official or public sources where permitted. That data remains subject to the relevant source terms, disclaimers and availability. Road Alert may filter, summarise or reposition events to improve road awareness, but it does not guarantee completeness or accuracy.
Planned features
References to planned features, including turn-by-turn navigation, vehicle navigation and truck or permit routing, are development goals only. Planned features may change, be delayed, be limited, or not be released.
No government affiliation
Road Alert NZ is not affiliated with, endorsed by, or operated by NZTA Waka Kotahi, NHVR, Police, transport agencies, councils or any government agency unless expressly stated.
Privacy
Use of Road Alert is also governed by the Privacy and User Data Policy, which explains location use, reports, feedback, retention and deletion requests.
Consumer rights
Nothing in these terms is intended to exclude, restrict or modify rights that cannot legally be excluded under applicable law, including the Consumer Guarantees Act 1993 or Fair Trading Act 1986 where those laws apply.
Changes to the service
Road Alert may change, suspend or stop features, data sources, alert types, settings or access at any time.
